We, Friends Color Images Private Limited (“FCI”) recognize that your privacy is of utmost importance and take it seriously. This privacy policy (“Privacy Policy”) sets out how we collect, use and disclose your data when you use the website, ‘https://www.fci-ccm.com/’ (“Website”).

References to “we”, “our” or “us” or the “Company” shall mean the Website and/or FCI.  Any references to “you”, “your” or “user” shall mean any person or entity using our Website. We will not use or share your information with anyone except as described in this Privacy Policy.

By using the Website, you agree to the terms and conditions of this Privacy Policy. You confirm that you are 18 years and above prior to access of the Website. The present Website is not for usage for any person below the age of 18 years old.  You also consent to our use and disclosure of your Personal Information (as defined below) in the manner described in this Privacy Policy.

    1. The Website is owned and managed by FCI, a Customer Communications Management organization, engaged pan India and the United States of America. This Privacy Policy applies to all current and former users accessing or using the Website, or otherwise engaging with us through email or other means. The Website is hosted on an Indian server.
    2. The collection and processing of information in the course of our delivery of services by us, or other contractual or commercial engagements that we may enter into, will be done in accordance with the specific terms applicable thereto, and not by this Privacy Policy.
    3. By accessing or using the website or by otherwise giving us your information, you confirm that you have the capacity to enter into a legally binding contract being 18 years and above and have read, understood and agreed to the practices and policies outlined in this Privacy Policy.
    4. You hereby consent to our collection, use, sharing, and disclosure of your information as described in this Privacy Policy.
    5. We may modify, add or delete from, this Privacy Policy from time to time, and your continued access to, or use of the Website, will be deemed to be an acceptance of the said changes. If you do not agree with this Privacy Policy at any time, in part or as a whole, do not access/use the Website or services provided through the Website, or provide us with any of your Information.

    1. Some of the information collected by us may qualify as Personal Information under the applicable data privacy laws of India, including but not limited to the Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data and Information) Rules, 2011, the Digital Personal Data Protection Act, 2023.
      We understand that all such information is being provided by you to us is voluntarily. Collection, use and disclosure of Personal Information requires your express consent and by using or accessing the Website and providing us with your Personal Information in any manner, you are providing us with your consent to our use, collection, retention, transfer and disclosure of the Personal Information in accordance with the terms of this Privacy Policy.
    2. In the event of change in any applicable laws, we may reach out to you for obtaining additional consents as required under such law and require you to comply with such requests. In case you do not wish to provide us with such additional consents, we may be unable to provide you all the services and access to the Website. Similarly, you may choose to not provide us with or withdraw any or all information included under Personal Information, but in the event that you do so, we may be unable to provide you access to the Website or provide you the services for which your information is being collected or processed.
  7. Disclosure of the Information
    1. We may employ third-party companies, service providers and/or individuals due to the following reasons:

      • To provide the services on our behalf.
      • To perform service-related services.
      • To assist us in analyzing how our services are used.
      • To curate new services and improve the services provided.

We want to inform our ‘Service Users’ that these third parties have access to your personal information, on a ‘need to know’ basis, so as to enable such third parties to perform the tasks assigned to them on our behalf.     1. We endeavor to maintain physical, technical and procedural safeguards that are appropriate to protect your information against loss, misuse, copying, damage or modification and unauthorized access or disclosure. Reasonable security controls are in place that includes people, process and technology that has been implemented to secure the location. Controls to protect the location includes access control, CCTV, and restriction of paper files, on a ‘need to know’ basis. Further, we review our information collection, storage, and processing practices, including physical security measures, to prevent unauthorized access to our system. We also restrict access to third parties and bind them via reasonably strict confidentiality obligations in case such access is provided for legal purposes.
    2. If you are an employee with such authorization it is imperative that you take the appropriate safeguards to protect such Information. Paper and other hard copy containing Personal Information (or any other confidential information) should be secured in a locked location when not in use. Computers and other access points should be secured when not in use by logging out or locking. Passwords and user ID's should be guarded and not shared. When no longer necessary for business purposes, paper and hard copies should be immediately destroyed using paper shredders or similar devices. Do not leave copies in unsecured locations waiting to be shredded or otherwise destroyed. Do not make or distribute unauthorized copies of documents or other tangible medium containing personal data. Electronic files containing Personal Information should only be stored on secure computers and not copied or otherwise shared with unauthorized individuals within or outside of Company.
    3. We will make reasonable efforts to secure Personal Information stored or transmitted electronically secure from hackers or other persons who are not authorized to access such Information.
  9. Third Party Links
    1. The Website may contain links to third party websites and services (“Third Party Services”) and such third parties have not been employed by us. We have no control over such Third Party Services, which are provided by persons or companies other than us. We are not responsible for any collection or disclosure of your information by such companies or persons thereof.
    2. Further, we are not liable for any loss or damage which may be incurred by you as a result of the collection and/or disclosure of your information via Third Party Services. We shall not be liable for any disputes arising from or in connection with such transactions between you and the aforementioned third parties.
    3. Such third party websites, and external applications or resources, accessible via the Website may have their own privacy policies governing the collection, storage, transfer, retention and/or disclosure of your information that you may be subject to. We recommend that you exercise reasonable diligence, as you would in traditional online channels and practice judgment and common sense before committing to any transaction or exchange of information, including but not limited to reviewing the third party website or application’s privacy policy.
  10. Retention and Destruction
    1. In compliance with the data privacy laws of India, including but not limited to the Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data and Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 we have put in place measures such that your Personal Information, which is in our possession or under our control, is destroyed and/or anonymized as soon as and in any case, within 5 (five year of it being reasonable to assume that (i) the purpose for which that Personal Information was collected is no longer being served by the retention of such Personal Information; and (ii) retention is no longer necessary for any other reason including applicable law. This is done by periodic review and erasure of the information collected, via software in place for this purpose.
    2. Further, If you wish that we no longer use your Personal Information in accordance with the terms of this Privacy Policy, contact us at info@fci-ccm.com. We, however, reserve the right to retain, store and use your information including Personal Information for our business purposes, whether such information has been deleted or not. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our services effectively, which anonymization is done by identifying and deleting personal identifiers relating to your information, via software in place for this purpose.
    3. Upon deletion of data as per Clause 5.1 or 5.2, we follow a deletion process via software mechanisms that ensures that there is no accidental breach of security of information. The information is deleted from the computerized medium completely and is not retained in any alternate files. However, we may retain certain information as may be necessary for business purposes, which is anonymized.
    4. Please note that your withdrawal of consent to use your Personal Information may result in us not being able to provide you with access to the Website or terminate any existing relationship that we may have with you.
    5. Our Employees have the right to review their information and seek modification during the course of the employment.
    6. In case of new information provided by the employee, such as training and new skills, we update the same in their records. The above stated retention policy applies to such employees also.
  11. Extent of Liability of FCI
    1. The maximum cumulative liability of FCI, shall in no event exceed 100% (hundred percent) of the aggregate value of all sums paid by you for services availed through the Website from FCI.
    2. We shall not be liable for any delay or failure in availability of the Website, as a result of network or connectivity failure, device or application failure, possible down time or any other technical or non-technical error of any nature, whether foreseen or unforeseen.
    3. You shall at all times, adopt all security measures on device(s) utilized by you to access the Website, that are necessary to prevent any breach of security of data. FCI shall not be liable in case any malicious or harmful code, viruses, Trojan Horses, worms, time bombs, cancelbots, or other malware are incorporated in your device(s) by you knowingly or unknowingly, which may lead to breach and/ or compromise of security of data and information shared by you through the Website. Further, you shall be liable to indemnify, hold harmless and keep indemnified FCI against all losses and/ or damage suffered by FCI on account of any such breach or compromise of security of information and data.
